1. Who we are

ModularHero ("we", "us") is a website at modularhero.com that teaches modular synthesis through lessons and challenges played in your browser. It is operated by ModularHero, Av. de los Shyris, 170138 Quito, Ecuador. You can reach us at hello@modularhero.com.

By creating an account or using the site, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the site.

2. Your account

• You need an account to play. Keep your sign-in details safe: you're responsible for what happens under your account.
• You must be at least 13 years old, or the minimum age to use online services in your country if it is higher. To buy a subscription you must be an adult, or have your parent's or guardian's permission.
• Give accurate information, and one account per person.

3. The free plan and Studio Pass

The free plan gives you the first course and the features described on our pricing page, at no cost. Studio Pass is a paid subscription that adds what that page lists for it. We may improve, change or add to the content and features over time.

4. Payments, and our reseller

Our order process is conducted by our online reseller: Paddle.com or Polar Software, Inc. (Polar), as shown at checkout. The reseller is the Merchant of Record for all our orders: it processes your payment, charges any sales tax or VAT, issues your receipts and invoices, and handles billing questions and returns. Your purchase is also subject to the reseller's own buyer terms, shown at checkout. We never see or store your full card details.

5. Subscriptions and renewal

• Studio Pass is billed in advance, monthly or yearly, at the price shown at checkout, in US dollars plus any tax that applies.
• It renews automatically at the end of each billing period, for the same period, until you cancel.
• If we change the price, we'll tell you by email at least 30 days before it applies to you. The new price applies from your next renewal; if you don't want it, cancel before then.
• If a renewal payment fails, the reseller may try again for a while. Studio Pass stays on during that time, and ends if the payment can't be collected.

6. Cancelling

You can cancel Studio Pass at any time. Cancelling stops future renewals: Studio Pass stays on until the end of the period you already paid for, and then your account returns to the free plan.

When Studio Pass ends, you keep everything you earned: your progress, points, stars, modules and badges. The content that needs Studio Pass locks again until you subscribe again.

7. Refunds

You can get a full refund within 30 days of your first payment. The details are in our Refund Policy. A refund ends Studio Pass straight away. Nothing in these Terms limits the rights consumer law gives you.

8. Using the site fairly

Please don't:

• share your account, or resell or redistribute access to paid content;
• copy, scrape or download the lessons, sounds, images or other content, except where the site offers a download;
• cheat: use bots, scripts or tricks to earn points, stars, badges or a place on the leaderboard;
• attack, overload or try to break into the site, or get around its limits or its paywall;
• use a name or picture on your profile that is offensive, or that pretends to be someone else.

We may remove points, badges or leaderboard places earned by cheating, and suspend accounts that break these rules.

9. Our content, and yours

The lessons, challenges, sounds, images, modules, software and design of ModularHero belong to us or to those who license them to us. A subscription gives you a personal, non-transferable right to use them on the site for your own learning; it doesn't transfer any ownership.

The patches you build and the recordings you make of them are yours. Recordings stay in your browser unless you choose to download or share them.

10. The service

We work to keep the site available and correct, but it is provided "as is": we can't promise it will always be available, uninterrupted or free of errors. We may change or retire features. If we ever stop offering Studio Pass, we'll refund the unused part of any period you have paid for.

11. Ending your account

You can stop using the site at any time, and ask us to delete your account by writing to hello@modularhero.com. We may suspend or close an account that seriously or repeatedly breaks these Terms; if we close it without a breach on your part, we'll refund the unused part of your subscription.

12. Liability

To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to you for any claim is limited to the amount you paid us in the 12 months before it. Nothing here limits liability that can't be limited by law.

13. Law

These Terms are governed by the laws of Ecuador. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and may bring a claim there.

14. Changes to these Terms

We may update these Terms. If a change matters, we'll tell you by email or on the site before it applies. The date at the top shows the latest version.
